1. Introduction

These Terms and Conditions govern your use of this website and any online tutoring services provided by Nick Gardner (“we”, “us”, or “our”). By accessing this website or engaging our services, you agree to be bound by these Terms. If you do not agree, you must not use this website or our services.

2. Online Tutoring Services

We provide live online tutoring and educational support, including one-to-one and small-group sessions, delivered via video conferencing platforms.

While all tutoring is delivered to a high professional standard and informed by educational research and experience, we do not guarantee specific academic outcomes. Progress depends on student engagement, attendance, independent study, and external factors beyond our control.

3. Eligibility and Parental Responsibility

Our services are provided to students of school age and above. Where the student is under 18, a parent or legal guardian:

  • must provide consent for tutoring,

  • is responsible for communication, scheduling, and payment,

  • remains responsible for the student’s conduct during sessions.

4. Bookings, Fees, and Payment

All fees will be agreed in advance and confirmed in writing.

Unless otherwise stated:

  • Sessions are payable in advance.

  • Fees are charged per session or as part of a block.

  • All prices are listed in GBP unless stated otherwise.

  • Late or non-payment may result in suspension or termination of services.

5. Cancellations, Rescheduling, and Refund Policy

Cancellations and Rescheduling

  • Cancellations or rescheduling requests must be made at least 24 hours before the scheduled session.

  • Sessions cancelled with less than 24 hours’ notice may be charged in full.

  • Missed sessions (including failure to attend or log in) are not refundable.

We reserve the right to reschedule sessions due to illness, technical issues, or unforeseen circumstances. In such cases, an alternative session or credit will be offered.

Refund Policy

  • Refunds are not provided for individual completed sessions.

  • Block bookings may be refunded on a pro-rata basis for unused sessions, at our discretion.

  • Refunds will not be issued where termination results from breaches of these Terms.

  • All refund decisions are final.

6. Student Conduct and Learning Environment

To ensure safeguarding, professionalism, and effective learning, the following conditions apply to all online tutoring sessions:

  • Students are expected to attend sessions punctually and prepared.

  • Cameras must remain on for the duration of the session, unless explicitly agreed in advance.

  • Students must participate from an appropriate shared or study space (e.g. desk, study, kitchen table).

  • Tutoring must not take place in bedrooms or other private spaces.

  • Students should be dressed appropriately and conduct themselves respectfully at all times.

  • Disruptive behaviour, inappropriate language, or failure to engage may result in the session being terminated.

Repeated failure to meet these expectations may result in withdrawal of services without refund.

7. Technical Requirements

It is the responsibility of the student and/or parent to ensure:

  • a stable internet connection,

  • a functioning camera and microphone,

  • access to the agreed online platform.

We are not responsible for lost time due to client-side technical issues.

8. Intellectual Property

All teaching materials, resources, recordings (if applicable), and content provided during tutoring sessions remain the intellectual property of Nick Gardner unless otherwise stated.

Materials may be used for personal educational purposes only and may not be shared, reproduced, or distributed without written permission.

9. Recording of Sessions

Sessions may not be recorded by students or parents without prior written consent.

Where sessions are recorded by us (for safeguarding or quality assurance purposes), this will be communicated in advance and handled in accordance with data protection legislation.

10. Website Use

You agree to use this website lawfully and not to attempt to misuse, disrupt, or interfere with its operation.

11. Data Protection and Privacy

We process personal data in accordance with UK data protection legislation. Please refer to our Privacy Policy for details of how personal information is collected, stored, and used.

12. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for indirect or consequential loss arising from use of our services.

  • Our total liability shall not exceed the fees paid for the relevant service.

Nothing in these Terms excludes liability for death or personal injury caused by negligence or for fraud.

13. Changes to These Terms

We reserve the right to amend these Terms and Conditions at any time. Changes take effect upon publication on this website. Continued use of services constitutes acceptance of the revised Terms.
